PLANTING AND DECORATIONS
1. Flowers may be planted or arranged at the base of the monument, in an area not to extend beyond the width of the monument, in the planting area only.
2. The planting of trees shrubs, rose bushes, thorny plants, vines, ivy, pachysandra and perennial flowers is prohibited. The Cemetery reserves the right to remove any of these plantings without prior notice. All flowers are subject to removal by management when they become unsightly.
3. For those of Catholic faith desiring the use of an eternal flame or light on a grave, such flame or light will be permitted. No open flames or lighting will be allowed.
4. Placing of glass vases, glass jars or any glass or shatter able. material is forbidden throughout all areas of the Cemetery.
5. In order to maintain the dignity of the Cemetery, and to allow for proper maintenance of the grounds and prevent a safety hazard, excessive decorations by the use of solar lights, stuffed animals, pinwheels, balloons, wind chimes, shepherd’s hooks (to hold hanging flowers), toys, photographs, and the like are not permitted and will be removed without prior notice.
6. The Cemetery does not undertake to maintain any individual flower areas in front of monuments or markers. This is the responsibility of the individual plot owners. Management shall have the authority, without liability, to remove all floral designs, flowers, plants, or artificial flowers from the plot space when it becomes unsightly, dangerous, withered, or unseasonable.
7. Artificial or plastic flowers of any kind are not allowed to be placed on any plot, grave space or urn space at any time from April 1st to Nov. 1st. Exceptions require written approval from Cemetery.
8. The Cemetery shall not be responsible for the care or loss or damage to plants, or plantings, caused by weather conditions, machines or other vehicles, thieves, or for any reason beyond its control.
9. Any enclosures, including fences, rocks, bricks and other materials are strictly prohibited.
10. Grave blankets and grave pillows for the Christmas season are permitted. However, all such decorations must be removed by Feb. 1st of the following year, and if not removed by then, will be removed by the Cemetery without notice.
MONUMENT AND MEMORIAL INFORMATION
1. Climbing or sitting upon or leaning against any stones or monuments is prohibited. Children under 16 years of age must be closely supervised by an adult while on the Cemetery grounds.
2. No visitor may drive or park a vehicle in or on any grass pathway or other grass area without special permission of Management.
3. Littering of any kind is prohibited. Receptacles placed along the pathways throughout the Cemetery are for disposal of flowers and planting materials only.
4. The Cemetery or its agents reserves the right to remove and replace monuments or monument dies in the course of interment operations.
5. Lot and/or grave space owners must allow at least 60 days after an interment before ordering a stone or monument. This is to allow for complete settlement of earth and for a thorough study and management approval of monument designs.
6. All grass markers ordered must be set in place on the foundation installed by the Cemetery not more than 15 days after completion of said foundation and notification of same by the Management.
7. Above grade footstones are not permitted in any section of the Cemetery. Only grass markers set 1” below ground level are to be used for such purpose.
Commack Cemetery, Inc. is a membership corporation organized and existing under the Membership Corporation Law of the State of New York. It owns and operates Commack Cemetery, Inc. under and in accordance with said laws of the State of New York. It reserves the right to refuse admission to the Cemetery and to refuse the use of any of the facilities of the Cemetery at any time to any person or persons whom the Management may deem objectionable to the best interests of the Cemetery. Entrance upon the Cemetery grounds shall obligate any or all persons including drivers of motor vehicles to observe all applicable rules and regulations, and entrance upon the Cemetery grounds shall be deemed agreement on their part.
GENERAL RULES
1. Entrance upon the Cemetery grounds by any or all persons automatically obligates such person to abide by these rules and regulations and any changes, revisions or additions thereto.
2. Persons within the Cemetery shall use the authorized avenues, roads, walks and paths only. No one is permitted to walk upon or across plots or grave spaces. The Cemetery expressly disclaims liability for any injuries or claimed injuries sustained by anyone violating this rule and the person or persons violating this rule accept the consequences for such violations.
3. Dogs are not permitted on the Cemetery grounds.
4. Employees of the Cemetery are not expected to work or render services on Sundays or holidays except when absolutely necessary, or as may be authorized by Management.
5. Persons visiting the Cemetery or attending funerals are prohibited from picking flowers, breaking or injuring any tree, shrub or plant, defacing or injuring any memorials, fence or other structure within the Cemetery grounds. Violators may be processed to the full extent of the law.
6. All fees or charges for services are payable at the Cemetery Office and plot owners are requested not to pay any fee or give any gratuity to any employee.
7. A Deed showing proof of ownership must be shown to Cemetery management before a grave will be opened or an interment made.
8. Hunting and the discharge of firearms, except at military funerals or memorial services, is strictly prohibited within the Cemetery enclosure.
9. All persons within the Cemetery should avoid conduct unbecoming a sacred place, such as, but not limited to:
a) Loud or boisterous conduct
b) Loitering or idling on the grounds
c) Bringing food or refreshments or consuming them on the Cemetery grounds
d) Peddling of signs, notices, or advertisements of articles within the Cemetery
PLOT, GRAVE & URN SPACE OWNERS
1. Grave spaces, plots or urn spaces may be purchased on an interest-free, deferred payment plan, the terms set forth in a contract made with the Cemetery. In the event a burial is to be made shortly after purchase, the balance due must be paid in full before interment can take place.
2. No plot or grave space may be sold or conveyed unless first offered to the Cemetery in compliance with the laws of the State of New York.
3. No plot, grave or urn space shall be used for any other purpose than for burial of the human dead. No pets of any kind may be buried with or without the human dead.
4. The Cemetery reserves to itself and to those lawfully entitled thereto a perpetual right of ingress and egress over plots, grave spaces, urn spaces or other areas for the purpose of passing to and from other plots where required for all Cemetery purposes, including operations, maintenance of grounds, and for all interment or disinterment procedures.
5. In preparing excavations, the Cemetery reserves the right to use temporarily the adjoining plot, grave space and urn space areas as well as any additional plot, grave space and urn space areas necessary to receive excavating machines and other materials as are required to perform all work.
6. It is the duty of the plot, grave or urn space owner to notify the Management of any change in his post office address, telephone number, email address in writing.
INTERMENTS
Right of designation for interment:
1. Interments in a lot are restricted to those entitled to burial therein according to the terms of Section 1512 of the Not-for-Profit Corporation Law. Permission for burial of those not entitled to burial according to the said Section must be filed with the Cemetery by the lot owner.
2. Interments and removals can be made only in accordance with the regulations of the Board of Health.
3. No interment shall be allowed without permission from the Cemetery. When an interment is to be made, a written order for same, signed by the owner, or his authorized agent, must be filed at the office. This order shall designate
a. The name of the deceased
b. Age of the deceased—including date of birth, if known
c. Place of birth of the deceased
d. Date of death
e. If not an adult, the names of parent(s) or legal guardian of deceased
f. The location of the grave
g. Name of undertaker
h. Exact size of box
i. Date of interment and time of arrival at cemetery
4. Notice of interment must be given at least 48 hours in advance to the Cemetery office.
5. The container for cremated remains to be interred shall be of a non-biodegradable material approved by the Cemetery.
6. Funeral directors conducting a funeral, upon arrival at the Cemetery, must present the necessary burial permit and sign the receipt for the body document.
7. Vertical or stick-in grave markers left at grave-site at time of interment by funeral directors or any person, other than the Management, are not permitted in the Cemetery and may be removed without notice of liability.
8. Following the death of plot owner(s), a family member is required to notify the Superintendent and furnish names of all heirs and their addresses for registry.
COLUMBARIUM RULES
1. Single niche measures 12”x12”x12”. Only one human cremated remains per single niche. Container for cremated remains to be inurned shall be of a permanent, non-biodegradable material approved by the Cemetery and in a size suitable for the niche.
2. The price for a niche space or spaces does not include etching of inscriptions and is subject to change without notice except as required by law. No inurnments shall be permitted in any niche in the columbarium until all payments due the Cemetery have been made.
3. Floral memorials, memorial lights, or other ornamentation may not be affixed to the columbarium niche. The Cemetery reserves the right to remove any such ornamentation without notice or liability. Fresh flowers may be placed at the base of the columbarium between April 1st and November 1st. Planting cones are provided in front of Cemetery office.
4. Disurnment of cremains in the Columbarium will not be permitted except upon written order of both the recorded owner and appropriate heirs of the person whose cremains are to be moved, or upon order of a court of competent jurisdiction and except upon full compliance with all applicable federal, state and local laws and the Rules and Regulations of the Cemetery.
